1. Acceptance of Terms

By accessing or using Flamly ("the Service"), operated by Flamly ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Flamly is an AI-powered content generation platform that helps users create carousel posts for social media platforms including TikTok, Instagram, LinkedIn, and others. The Service includes content generation, asset management, performance analytics, and direct publishing to connected social media accounts.

3. User Accounts

You must provide accurate, complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the Service.
You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these terms.

4. Content and Intellectual Property

Your Content: You retain ownership of any content you upload to the Service (images, brand assets, text). By uploading, you grant us a limited license to process, store, and display your content solely for providing the Service.
Generated Content: Content generated by the AI using your inputs belongs to you. You are free to use, modify, and distribute generated carousels as you see fit.
Platform Compliance: You are responsible for ensuring that content you publish to third-party platforms (TikTok, Instagram, etc.) complies with those platforms' terms of service and community guidelines.
Our Service: The Flamly platform, including its design, code, AI models, and branding, remains our intellectual property.

5. Third-Party Integrations

The Service integrates with third-party platforms including TikTok. By connecting your social media accounts:

You authorize us to access and interact with your account on those platforms within the scopes you approve.
We will store authentication tokens securely to maintain your connection.
You can disconnect your third-party accounts at any time through your Settings page.
We are not responsible for changes to third-party APIs, terms, or availability that may affect functionality.
When publishing content to TikTok, the platform may automatically add trending music to your carousel posts. This is governed by TikTok's own terms regarding music usage.

6. Acceptable Use

You agree not to:

Use the Service to generate illegal, harmful, misleading, or infringing content.
Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
Use automated tools to scrape, extract, or bulk-access the Service beyond normal API usage.
Impersonate others or misrepresent your affiliation with any person or entity.
Upload malware, viruses, or other harmful code.
Violate any applicable local, state, national, or international law.

7. Subscription and Billing

Free tier users have limited access to features and generation quotas.
Paid subscriptions are billed monthly or annually as selected.
You may cancel your subscription at any time. Access continues until the end of the current billing period.
We reserve the right to modify pricing with 30 days' notice to existing subscribers.
Refunds are handled on a case-by-case basis at our discretion.

8. AI-Generated Content Disclaimer

Content generated by the Service is produced by AI and may not always be accurate, appropriate, or error-free. You are responsible for reviewing all generated content before publishing. We do not guarantee that generated content will achieve any specific engagement, reach, or performance metrics.

9. Limitation of Liability

To the maximum extent permitted by law, Flamly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

11. Data and Account Deletion

You may delete your account at any time through the Settings page. Upon deletion, we will remove your personal data, projects, carousels, and connected accounts. Some data may be retained in backups for a limited period as required by law or for legitimate business purposes.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.
